GUEST POLICIES & PROCEDURES RENTAL AGREEMENT


Please read your Vacation Rental Agreement carefully before you begin your vacation. Any monies received by Toes N Sand Properties, LLC (herein referred to as Toes N Sand) for occupancy of Vacation Property indicated the acceptance of the terms of our Vacation Rental Agreement in full. All policies are strictly enforced. It is the responsibility of all guests and members of their party to be familiar with all policies pertaining to rental.

VACATION RENTALS
Summer season:  3 or 4 nights minimum (varies by owners)
Fall & Winter 3 days minimum, Spring 4 days minimum
We accept Cash, Personal Checks, Debit/Credit Cards, Money Order. There will be a 3.75% convenience charge for using a Debit/Credit Card for reservation payments.
Regardless of your actual arrival and departure date, guests are responsible for payment of all nights reserved.
There are no refunds for early departure.
In lieu of a security deposit, accidental rental damage waiver protection plan is purchased for$ 45.00. We have partnered with RentalGuardian. To view accidental rental damage plans visit  http://www.rentalguardian.com/. Coverage plans of  $1500 is the only option to meet this requirement. Intentional damage or damage that exceeds the limits of coverage plan the guest is responsible. Damage Protection insurance has to be added before 60 days of arrival. Monthly stays require all rent and fees have to be paid fully before 60 days before arrival. By submitting payment for this plan, you authorize and request RentalGuardian Damage Protection and Insurance Services to pay directly Toes N Sand Properties any amount payable under the terms and conditions of the Vacation Rental Damage plan. 
Trip Cancellation and Travel Insurance available is offered via RentalGuardian.com. Trip Cancellation and Travel Insurance has to be added and paid before 30 or 60 days depending if the stay is weekly, daily or monthly.
6%, 11.5% or 13%  Lodging Tax is required on all rental charges and Cleaning fees after departure (varies by unit)
A non-refundable, reservation processing fee (varies by property) is charged  at time of reservation The rent and fees payment of 25%  are due at time of making the reservation to avoid cancellation.  All rentals balances of weekly and daily stays are due 30 days prior to arrival. Monthly stays require rent and fees to be paid in full 60 days prior to scheduled arrival. If the reservation is made less than 30  or 60 days of arrival then the entire rental payments are required to be paid at time of reservation.  A $35.00 service charge will be incurred for any returned checks.
Rental rates and taxes are subject to change and holiday/special event rates may differ. Property Protection Program. Our properties and their contents are valuable and reasonable care should be taken with them during their rental. Our company, including the participating rental property homeowners we represent (“we”, “our”, “us”), is an additionally-insured participant in a Property Protection Program that reimburses certain costs for unintentional accidental damage to our properties during their rental occupancy. With our participation in this Program, except in certain circumstances, we may not collect and hold refundable pet, damage, or security deposits. We charge renters a non-refundable administrative fee to defer our costs for Program participation. If, during a renter’s occupancy, the renter or a member of renter’s party or renter’s guest causes any damage to real or personal property of our rental property as a result of unintentional accidental acts or omissions, the renter must notify our property management office at that time, and before check-out. For rentals that exceed the coverage limits of the Program, we may collect a supplementary refundable (net of any damage reimbursement) security deposit from renter upon check-in. Renter is liable to us for any damages caused by the renter or a member of renter’s party or renter’s guest that are not reimbursed to us or exceed the maximum per-incident limit of our coverage, and the credit card on file and/or any collected security deposit will be charged. If the renter wishes to pay a refundable (net of any damage reimbursement) damage security deposit, renter must notify us before check-in. Special or large event and/or pet deposits may be charged in certain situations. 

RIGHT OF ENTRY: Guest(s) agree that Toes N Sand Properties reserves the right to enter the rental property any time to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements as we may deem appropriate, or to show the property to prospective purchasers or guests (in which case prior notification will be given).

Note: If the vacation property is For Sale, we will do our best to avoid the interruption upon your vacation; however, if the need arises to show a property to a potential buyer during your vacation stay then we will contact you in advance to setup an appointment.

RESERVATION PRIORITY
We value our guests so you have the first option to reserve the same property for the same time next year.
During your stay, give us a call (251-200-1536) or stop by our office (address is located at end of agreement) Monday - Friday, 9:00 a.m. - 3:00 pm.
At 11:00 am, the property will be released for general availability on the day of your departure.
Convenient payment  plans are available for reservations made one year in advance.
If booking a calendar year, please note the rental rates may increase. You will be notified by Toes N Sand Properties if and when the rates increase.

CONFIRMATION
We will email a confirmation letter within 48 hours of your reservation to your address. If you find a discrepancy then please contact us immediately by phone - 251-200-1536.  Silence means the agreement is correct. Please verify: Arrival/departure dates, rental amount due, accommodations reserved.
The property is subject to change before check-in if necessary. We will make every effort to contact you before your arrival date should this occur.

OCCUPANCY
Occupancy is restricted by LIMITED to the MAXIMUM number of people as indicated on attached Reservation Agreement.
Parking is also LIMITED which depends on rental property.
Children 2 yr old and under do not count toward the occupancy.
Balconies and Decks should not be overloaded with excessive number of people.
No House Parties, weddings or receptions are Not Allowed unless pre-approved by TOES N SAND PROPERTIES AND PROPERTY OWNER.  If evidence of large groups that would over occupy or be detrimental any way to the property then immediate eviction without a refund  of rental and an additional charge will be charged on credit card on file.
NO PROPERTY WILL BE RENTED TO VACATIONING STUDENTS.
Random drive-by visual inspections for occupancy and parking restrictions at any time during your stay. Violations of occupancy and parking rules may result in loss of rent and eviction. Campers, RVs, and Motor Homes are not allowed on property.
If renters leaves doors & or windows open with the air conditioner or heater running in unit during their stays, then a $200 charge will be charged on credit card on file.
Monthly renters are required to pay monthly rate plus electric. Rent and electric are due per month. Upon arrival and again before departure, a meter reading will be collected. Electric will be calculated and must be paid before departure. Only cash, money orders or certified checks are accepted to pay electric usage. No refunds for early departures. No units can be sub-leased unless approved in writing from property owner.
If keys are lost during your stay and a locksmith is called then the service fee has to be paid by you at time of service.
If you are interest in a groceries and necessities service which is ordered online and delivered on day of your arrival, then please contact our office. We will be glad to set it up for you.

AGE RESTRICTIONS
The individual making the reservation must be 25 years or older and is required to occupy the property the entire rental stay. Unless accompanied by parent or legal guardian, then Singles under 25 years old are prohibited. For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit card holder. This person is considered to be the Guest.  All other persons involved with the rental are considered to the Guest's invitees, and all discussion regarding reservation, cancelation, and damage policies will be discussed with the Guest, not the Guest's invitees. The Guest understands that Toes N Sand Properties rents to responsible adults 25 years or older only.
During Spring Break vacation rentals, additional restrictions may be implemented.

PETS POLICY
Book a Dog Property by calling Office 251-200-1536, no reservations with pets are allowed online. A Non-Refundable and Refundable Deposit + Tax per Dog will apply to all pet reservations. The office will explain the cost of deposits and provide a pet addendum. A pet addendum must be signed & returned to Toes N Sand Properties before arrival.
If the property DOES  NOT ALLOW PETS AND EVIDENCE IS FOUND, IMMEDIATE EVICTION AND LOSS OF UNUSED RENT WILL BE ENFORCED.

FIREARMS
All properties DO NOT ALLOW FIREARMS AT ANY TIME. If any firearms are found after your departure there will be an additional charge to the credit card on file and the firearm will be  turned over to appropriate law enforcement agency.

SMOKING
ALL PROPERTIES ARE NON-SMOKING. NO EXCEPTIONS. IF THERE IS ANY EVIDENCE OF SMOKING DURING YOUR STAY, WE WILL CHARGE YOUR ACCOUNT $250.00.

FIREWORKS
Fireworks are not permitted

PLUMBING: Do not put any feminine products in the toilet. The toilets are water-saving models and don't have a strong flush - limiting the amount of toilet paper used will help prevent a clog. Plungers are provided if a clog occurs. Please do not pour grease down the drain.

GRILLING
No grilling on balconies, decks and porches except properties with built-in grills. Some properties have designated areas for grilling.
Please note the cleaning and condition of grills are not guaranteed.

TENTS
Some properties allow Pop-up tents.
There are strict rules regarding tents on the beach such as location and placement.
No tents can be left on the beach overnight.

WEATHER
Should a hurricane or tropical storm threaten our area and evacuations are required by our local governing officials, RentalGuardian will refund to the renter who made the reservation.
The insurance has to be purchased before the storm was named and before you final payment was due.
Toes N Sand Properties will NOT issue any refunds.

HOUSEKEEPING
Prior to your arrival and after your departure, your rental will be cleaned.
You must contact our office on your arrival date if you find cleaning issues.
CLEANING FEE(s): A non-refundable cleaning fee is required with all reservations. This fee is for our housekeepers who dust, vacuum, sanitize, clean linens and towels, and remove refuse from the property. Guest(s) are required to follow all check out procedures detailed in this agreement and leave the property in the same general and good habitable condition it was in when the Guest(s) arrived. Undue and/or unreasonable cleaning of the rental property shall be charged to the Guest's/Cardholder's credit card as an Additional Cleaning Charge at a rate of up to $45/hour, with a one hour minimum. This also applies to the property exterior, grounds, BBQs and hot tubs (if so equipped).
CLEANING REQUIREMENTS: A starter supply of expendable supplies such as paper goods and soap is provided; please bring additional if you feel this will not be adequate. Basic cleaning supplies are stocked to do your own cleaning during your stay. Housekeeping is not provided during your stay unless previously arranged. Failure to comply with pre-departure cleaning requirements resulting in excessive cleaning will be charged to your credit card at $45/hour, with a one-hour minimum:

1) Place soiled towels in the bathtub.
2) All dirty dishes, cookware and eating utensils should be washed, rinsed, dried and put away in the proper location.
3) Floors should be in generally good condition and ready to be vacuumed by our housekeepers.
4) All household trash, garbage, recycling and/or other discarded items should be properly bagged up so as to avoid spillage/leakage, and deposited in the proper refuse containers provided. Please do your best to help us recycle by hauling it out with you. 
5) Refrigerator and microwave should be left clean and free of food.
6) All appliances (stove, oven, BBQ, etc.) should be left in a clean condition and free of spills and grease.
7) Please wipe down counters and other surfaces.
8) All litter must be picked up from the premises and placed in the outside garbage cans, tied securely in trash bags.
9) Please try not to leave any pet hair in the home! Duct tape works great on furniture and may be provided with our other cleaning supplies.
10) GLITTER AND CONFETTI ARE NOT ALLOWED AT ANY PROPERTY, INSIDE OR OUTSIDE.

LINENS & TOWELS: Bath towels, sheets, pillows and blankets are provided. We do not provide any linens or towels for outdoor use. DO NOT take the rental property's linens or towels outside. 


APPLIANCES & ELECTRONICS
Appliances, Televisions, Surround Sound System, VCRs, DVD Players, internet access, stereos, telephone, cable or satellite in rental units are NOT GUARANTEED.
NO REFUNDS or RATE ADJUSTMENTS will be given for malfunctioning equipment or mechanical failures.
We  promise to have them repaired by the appropriate companies as soon as possible. We will notify and report the problem to appropriate company for repair.
Malfunctions are out of our control.
Maintenance technicians, pest control and any other needed vendors may access the property for purposes of repairing previously reported issues.
At your departure time, all Surround Sound System,Televisions, VCRs, DVD Players, must be connected & in the same working order as upon your arrival.
A $30 charge plus the invoice charged by repair technician will be charged on credit card on file if we have to send maintenance or technicians to repair any of these items.
At time of check-in, please notify our office @ 251-200-1536 if any problems.
All properties are privately owned and have different subscription packages for cable and/or satellite and internet. Toes N Sand Properties does not guarantee any programs, events or reception. Guest(s) are liable for ordering any Pay Per View - if Guest(s) does not use their own credit card for ordering, programming charges plus an additional $5.00 processing fee will be charged to the credit card we have on file

FINAL PAYMENT
Final payment is due 30 days before arrival for daily and weekly stays. Monthly stays requires the final payment to be paid prior to 60 days before arrival.
If final payment is not paid prior to 30 or 60 days before arrival depending on rental stays, then your reservation will be canceled and a refund of your initial payment will be issued minus a $69 cancelation fee.
We gladly accept Cash, Personal Checks, Money Orders, or Cashier’s Check, VISA, MasterCard, American Express and Discover. A credit card is required to be on file.  A $35.00 service charge will be incurred for any returned checks.

CANCELLATIONS
After the initial payment has been processed and outside the cancellation date range (30 days for daily or weekly stays and 60 days for monthly stays), Refunds are issued by check only. Date changes and unit assignments changes are permissible without penalty.
The Refunds will include the initial payment less a $69 cancelation fee and the cost of the travel insurance.
The entire payment will be forfeited for cancelation; date changes or unit changes if inside 30 days for daily and weekly stay; 60 days for monthly stays. This loss can be avoided if Rental Guardian Insurance - Travel Insurance was purchased and the reason for cancelation is covered under the travel insurance policy. All reservation changes must be acknowledged in writing. If purchased Travel Insurance before the final payment was due you can contact RentalGuardian to file a claim for a refund.

CHECK-IN/CHECK-OUT
Check-in time begins at 4pm CST. Early check-in time may start at 3pm CST  as long as  housekeeping and/or maintenance has finished with the property.
Please read your final confirmation for check-in instructions.
Some properties require check-in at our office located at The Wharf - Keller Williams Realty Alabama Gulf Coast, 4725 Main Street, Suite F228, Orange Beach, AL 36561. Other properties require check-in at rental property.
Check-out is by 10 am CST. This rule is STRICTLY ENFORCED.

INDEMNIFICATION & HOLD HARMLESS: While Toes N Sand Properties and its Property Owners strive to maintain Vacation Properties in the finest condition, no guarantees are expressed nor implied regarding suitability or for any particular purposes. All Guest(s) and their invitees use the Vacation Property structures and premises at their own risk. Toes N Sand Properties and its Property Owners shall not be held liable or otherwise responsible in any way for injury to any Guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said Guest(s) and/or invitees, or by the failure of structures, appliances, (including hot tubs and BBQ's) furnishings, and/or other equipment, whether by malfunction, misuse, acts of God/nature, and/or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the Vacation Properties and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the Vacation Property and/or its contents. Toes N Sand Properties and its Property Owners shall not be held liable nor otherwise responsible in any way for allergic reactions to Guest(s) or invitees, caused or permitted to be caused by materials utilized in the manufacture of the Vacation Property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this Agreement, Guest(s) and invitees hereby agree to forever hold-harmless and indemnify Toes N Sand Properties and its Property Owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the Guest(s) use of the property.

TOES N SAND PROPERTIES have taken every precautions to ensure accuracy, however we reserve the right to correct errors.
